eArchiving, the cloud with legal effect

More than just storage: eArchiving, designed by Garrigues, is a custody service that allows you to deposit any critical digital file with a registered, neutral and independent qualified trust service provider (QTSP), such as EADTrust.

We use EU “sovereign technology” (100% European jurisdiction and operation) and we register and certify the files stored, generating, if necessary, an evidence certificate as proof of the existence and integrity of the file and the date of the deposit.

Legal framework (eIDAS 1.0 anticipating eIDAS 2.0)

eArchiving is a service designed in accordance with the strictest regulatory standards for certification and custody of electronic documents. At European level, eArchiving complies with Regulation (EU) 910/2014 on electronic identification and trust services (eIDAS). This means it enjoys the presumptions of accuracy and integrity provided for in article 41.2 of the Regulation.

Each EU member state may also introduce legislation that reinforces the value of qualified trust services, as is the case in Spain, where article 3.2 of Law 6/2020 refers to the presumptions of article 326.4 of Civil Procedure Law 1/2000.

Frequently asked questions

What is eArchiving and how is it different from conventional cloud storage?

eArchiving is not just “saving in the cloud”. It is digital custody with legal value. Our service allows you to store all types of documents in the cloud, but with one major difference: it is a regulated service that complies with the EU eIDAS Regulation through the use of qualified time stamps. This means that documents stored in eArchiving have a presumption of veracity and that the burden of proof is reversed (the latter in the Spanish jurisdiction), something that conventional storage does not offer. Moreover, eArchiving stores documents in Oracle’s sovereign cloud, guaranteeing they are always securely located within the jurisdiction of the European Union and preventing international data transfers. Where possible and in accordance with the law, eArchiving notifies and, where appropriate, challenges access requests from third-country authorities that are not valid or not applicable to your information.

Does eArchiving issue custody certificates? What information do they contain?

Yes, eArchiving issues a custody certificate for every stored document in which EADTrust, as trust service provider, certifies the date and time at which the custody of the information began, the digital fingerprint (hash value) and size of the stored documents, the reference to the applicable legislation and its legal effects, and the technical data for public verification of the integrity of information.

What guarantee is there that the document has not been altered?

The guarantee of integrity of documents stored by eArchiving is based on a technological process that combines several layers of security. Firstly, a hash value, which is a unique fingerprint created using a cryptographic algorithm, is generated for each file. Any change to the content of the document will produce a completely different hash value, allowing any alteration to be detected. This hash value is then associated with a qualified time stamp issued by EADTrust that certifies the existence and exact content of the document at a specific date and time in accordance with the eIDAS Regulation. Thanks to this system, you can prove at any time that the document has not been modified since its certification and that its integrity is fully guaranteed.

How long can documents be stored for? Is the certificate renewable?

You can currently store your documents indefinitely, as long as you keep your paid subscription active. In read-only subscriptions, evidence will be deleted after 12 months.

Where are documents stored and what level of security does the infrastructure offer?

Documents stored in eArchiving are hosted on the Oracle European Union Sovereign Cloud (EUSC), whose data center regions are operated and supported exclusively by personnel residing in the EU, physically located in the EU and employed by EUSC entities, with physical and logical access restricted so that only these employees can operate the platform. These employees and the managers of EUSC entities are contractually obligated not to share content with third parties and to follow strict procedures for requests for access from third parties. They also undergo annual training in privacy and information protection. On a technical level, EUSC regions are physically and logically isolated from the rest of Oracle’s regions, backup copies remain within the EU and CDN services are disabled to prevent data movements outside the region, thus preserving the sovereignty, confidentiality, integrity and availability of the information. When possible and in accordance with the law, Oracle notifies and, where appropriate, challenges invalid or unenforceable government requests, and limits responses to the minimum strictly necessary.

Is this service equivalent to the qualified electronic archiving service provided for in the eIDAS?

Qualified electronic archiving services were introduced in Regulation (EU) 910/2014 (eIDAS) as a new digital trust service by Regulation (EU) 2024/1183. However, the implementing acts that technically define this service have not yet been approved, so our eArchiving service is not, for the time being, a qualified electronic archiving service under the terms of Article 45(j) eIDAS. However, we are already working on the draft technical standards and, in the meantime, using the EADTrust qualified time stamp and company seal means that stored documents enjoy the presumptions of integrity and accuracy provided in article 41.2 eIDAS and in Spanish digital trust legislation.

Can eArchiving be integrated with Signature Manager or other document management platforms?

Yes, eArchiving can be integrated with other document management platforms to give documents hosted on them the same legal validity as those hosted on eArchiving.

Is it possible to automate the upload of documents from our internal systems?

Yes, eArchiving can be integrated with other platforms through the use of our APIs.

Does eArchiving allow for storage of versions or traceability of document modifications?

Yes, eArchiving allows you to maintain the traceability of your documents. Every time you upload a new modified version, a new hash value will be generated and the new version will be recorded, ensuring the tracking and integrity of each change.
